GENERAL CONDITIONS OF SALE

The present conditions are concluded exclusively between ENERGY BIKE, a Société par Actions Simplifiée à capital variable (simplified joint stock company with variable capital), registered with the Registre du Commerce et des Sociétés de Cannes under number 845 175 595 00022, whose registered office is located at 15 BOULEVARD GÉNÉRAL VAUTRIN RÉSIDENCE VICTOR HUGO06400 CANNES, hereinafter referred to as “energy-bike. fr” or “the Site” and any person making a purchase on the energy-bike.fr site, hereinafter referred to as “the Internet user” and collectively referred to as “the Parties”. The Internet User declares that he/she is of legal age or has parental authorisation and that he/she has the legal capacity to enter into a contract enabling him/her to place an order on this Website. The Parties agree that their relations are governed exclusively by these general terms and conditions of sale. These conditions may be subject to change. Therefore, it is understood that the applicable conditions are those in force on the site at the time the order is placed on the Site.

Article 1 – Availability

Our product and price offers are valid as long as they are visible on the Site, except for special operations whose validity period is specified on the Site. The Internet user is invited to consult the availability of the items sold on the information page of each product.

In the event of an order for an item that proves to be unavailable, energy-bike.fr reserves the right to cancel the order, subject to notifying the Internet user.
In case of an order of several products, if one of the products is finally unavailable, energy-bike.fr will inform the Internet user of the impossibility of sending the unavailable item. The remainder of the order will be processed and shipped to the customer within the timeframe announced by the order tracking information email. The Internet User may also opt for the total cancellation of his/her order, provided that he/she informs the energy-bike.fr customer service department in advance by telephone or email.

Article 2 – Ordering

How do I place an order on energy-bike.fr?

The placing of your order is done in several steps:

– the Internet user fills his basket with products,
– the Internet user chooses the delivery method,
– the Internet user chooses his/her method of payment,
– the Internet user makes a payment request,
– The Internet user then receives an e-mail from energy-bike.fr registering his/her order,
– Finally, the Internet user receives an e-mail validating his/her order.

The order validation e-mail signifies acceptance by energy-bike.com of the Internet User’s order and thus forms the sales contract between the Parties. As soon as the order is ready to be dispatched, energy-bike.fr will send an e-mail to the Internet User confirming the dispatch of the order. The Internet user who has chosen a delivery in shop will receive an e-mail to make the order available.

Our prices

The prices displayed by default on the site are indicated in euros and include all charges applicable in Metropolitan France + Corsica.
VAT is applied at the rate in force at the time the order is placed. The prices of the products displayed on energy-bike.fr do not include shipping costs, the price of certain packaging or the price of other optional services, which are not included. The latter will be brought to the attention of the Internet user on the summary screen before final validation of the order.
energy-bike.fr allows you to see the prices of products sold in ENERGY BIKE shops in France. The prices displayed are the prices defined by the central purchasing ENERGY BIKE, these are maximum recommended prices, these prices may vary according to the commercial policy of each ENERGY BIKE shop.
In addition, the Internet user is informed that the offers of products and services as well as the prices proposed for purchase in ENERGY BIKE shops are not applicable to purchases on the energy-bike.fr website and vice versa.

What are the means of payment?

The user can pay by credit card, with a Visa card, Carte Bleue, Mastercard, E-Carte bleue, in 3X or 4X by credit card (according to specificities detailed below), with an Alsolia card or his Paypal account. The Internet user can also pay for his purchases via ENERGY BIKE gift card or e-cheque, and Illicado gift card. energy-bike.fr guarantees the security of payment by credit card by using the SSL (Secure Socket Layer) encryption system and by using the company Ingenico Payment services to process payments.

Payment of your order in 3X or 4X by CB from 100€ of purchase until 3000€ with payment

Our partner BNP Paris Bas offers you a financing solution called payment, which allows you to pay for your purchases from 100€ to 3000€ in 3 or 4 times with your bank card.

Conditions

This offer is reserved for individuals (natural persons of legal age) residing in France and holding a Visa or MasterCard bank card with a validity date greater than the chosen financing period.

Cards with systematic authorisation such as Electron, Maestro, Nickel etc., as well as e-cards, Indigo and American Express cards are not accepted.

How to subscribe

Once you have completed your order, simply click on the “Payment in 3 or 4 times by credit card” button. You will then be redirected to our partner’s payment page, where you will see a detailed summary of your order and a personalised financing request, which you must then validate.

You enter your personal information, read the general terms and conditions of payment in instalments to which you wish to subscribe, which are provided to you in PDF format so that you can read, print and save them before accepting them. You then notify your electronic acceptance by ticking the relevant box.

You acknowledge that the “double click” associated with the checkbox on the acknowledgement of the general conditions constitutes consent to contract and an irrevocable and unreserved acceptance of the general conditions of the product.

Unless proven otherwise, the data recorded by BNP Paris Bas constitutes proof of all transactions between you and BNP Paris Bas.

If you request to benefit from a financing solution offered by BNP Paris Bas, the information relating to your order will be transmitted to BNP Paris Bas, which will use it to study your request for the granting, management and collection of credit.

BNP Paris Bas reserves the right to accept or refuse your request for financing in 3 or 4 installments.

You have 14 days to withdraw from your loan.

How it works

Payment in 3 or 4 instalments by credit card allows you to pay for your order on our website in the following way:

– a compulsory deposit, debited on the day of the order confirmation, corresponding to one third of the order, to which are added fees corresponding to 1.45% of the total amount of the order for a 3 times payment and 2.2% for a 4 times payment (within the limit of 30€ for a 3 times payment and 15€ for a 4 times payment);
– two or three monthly instalments, each corresponding to one third or one quarter of the order, debited 30 and 60 days later for the 3 times and 30, 60 and 90 days later for the 4 times.
– Payment in 3 instalments from a purchase of €100 up to €4000Example: For a purchase of €300 made on 02/05/2018, you pay a deposit of €104.35 and then 2 monthly instalments of €100 on 02/06/2018 and 02/07/2018.
2-month loan at a fixed APR of 19.26%. Cost of financing: €4.35 up to a maximum of €15.
– Payment in 4 instalments from a purchase of €100 up to €4000 Example: For a purchase of €600 made on 02/05/2018, you pay a deposit of €163.20 then 3 monthly instalments of €150 on 02/06/2018, 02/07/2018 and 02/08/2018.
3-month loan at a fixed APR of 19.61%. Cost of financing: €13.20 up to a maximum of €30.

Special conditions for one-off promotional offers.
For payment in 3 instalments without charge: the cost of financing is 0% of the total amount of the order. Example: For a purchase of €150, a deposit of €50 then 2 monthly payments of €50. Credit for a period of 2 months at a fixed APR of 0%. Cost of financing: 0€.

For payment in 4 instalments without charge: the cost of financing is 0% of the total amount of the order. Example: For a purchase of €400, a deposit of €100 then 3 monthly payments of €100. Credit for a period of 3 months at a fixed APR of 0%. Cost of financing: 0€.

For Internet users with a valid Alsolia card, and once this payment method has been selected, the Internet user will be redirected to our Partner’s website in order to determine the chosen payment scale. It is specified that a credit commits the Internet User and must be repaid. Each Internet User must check his or her ability to repay before committing to a loan. If the Internet User chooses the Paypal payment method, he/she will be redirected to our Partner’s website and will then have to enter his/her password if he/she has a Paypal account. If they do not have such an account, they can create one on the said site. Personal and financial information is automatically encrypted when sending any sensitive information to the Paypal servers. In the case of a product return, the reimbursement will be made directly in the form of a credit to the Paypal account used for the payment of the original order. The account holder’s data will of course remain confidential.
The Internet user will be able to use one or more ENERGY BIKE gift cards to pay for all or part of his order on energy-bike.fr.

It may, depending on the amount of the order, either :

Use part of the amount of the gift card
Use multiple gift cards
Use the full amount of the available gift card and complete with another payment method

It is specified that the gift card can only be used on the website 24 hours after its activation in shop.
Finally, the Internet user can use one or more ENERGY BIKE loyalty vouchers to pay for all or part of his order on energy-bike.fr.
Only loyalty e-vouchers received by e-mail are accepted to pay for an order placed on energy-bike.fr. They include a 16-digit code and a 4-digit pin code, to be entered on the payment page when placing the order.

energy-bike.fr also reserves the right to refuse an order if there is a previous outstanding payment dispute or an abnormally high order level.

FOR USERS OF THE IN-STORE INTERNET TERMINAL

In the event that the user places an order via an Internet terminal made available in one of the ENERGY BIKE shops offering this service, payment will be made at the shop’s cash desk. In this case, the following payment methods will be accepted at the cash desk: credit card, Visa, Mastercard, cheque, cash, Alsolia, loyalty e-cheque, ENERGY BIKE and Illicado gift cards, gift vouchers
To proceed with a payment at the cash desk, the Internet user must tick the “payment at the cash desk” box when making his or her payment choice and follow the instructions described on the screen. Proof of order/payment.
In the absence of proof to the contrary, our computer records and those of our service providers, kept under reasonable security conditions, will constitute proof of all transactions between energy-bike.fr and the Internet user. In accordance with the regulations, we archive orders on a reliable medium. The Internet user can access this on the energy-bike.fr website in the “My account” area. In any case, energy-bike.fr recommends that the Internet User keep the order validation e-mail.

Article 3 – Delivery

Where do we deliver?

The products are only available for delivery in Metropolitan France and Corsica to the delivery address provided by the User on the order form. The Internet user can also choose to have the product delivered to the “Point Relais” of his choice (including ENERGY BIKE shops), when placing the order on the Website.

Do we deliver to collective addresses?

A so-called “collective” address is an address allowing the domiciliation of an establishment such as a school, a crèche or an association. In the case of a delivery to a collective address, the Internet User acknowledges that the service provided by energy-bike.fr for the delivery of the order ends with the actual delivery to the collective address indicated in the order, even though the product may be received by a third party. The transfer of risks to the Internet user takes place at this moment, it is therefore important that the Internet user takes all precautions to ensure the proper receipt of his order at this address. Due to numerous losses at these addresses, energy-bike.fr is not able to deliver to the premises of the armed forces.
In the case of delivery to certain areas that are difficult to access (such as Ile de Ré in mainland France, etc.), delivery is made to the nearest shipping centre. The final delivery may then be made by a carrier independent of the carrier used by energy-bike.fr. This delivery may give rise to additional invoicing by this carrier, as energy-bike.fr does not cover this additional cost.

What are the delivery times?

The delivery times announced on the site apply from the date of validation of the order by the site. The Internet user is informed of the shipment of his order by email.
In the case of a delivery at a relay point, including an ENERGY BIKE shop relay point, it is possible that the relay point chosen by the Internet user is closed (holidays of the shopkeeper,…), in this case the package will be dropped off at the relay point closest to the Internet user’s home. This information will be indicated in his Point Relais order tracking. The Internet user has a period of 14 days from the date of receipt in a Mondial Relay point or 14 days in a relay point of the ENERGY BIKE shop to recover the package. After this period, the package will be returned to energy-bike.fr. A refund will be triggered upon receipt in the warehouse of the returned order.

What do I do if I am not present at the time of delivery?

In the case of a delivery by La Poste, the Internet user who is not present at the time of delivery has a period of 10 working days to collect the package from the post office indicated. After this period, the package will be returned to energy-bike.fr. The Site will then make an initial reminder to the customer, in the absence of a response from the customer within 7 days energy-bike.fr will consider that the Internet user has exercised his right of withdrawal.
For delivery by appointment (heavy and bulky products), the carrier will contact the Internet user directly to agree on a delivery time. In the event of absence in relation to the agreed delivery time, the Internet user must inform energy-bike.fr at least five (5) working days before the agreed delivery date. Failing this, the additional presentations will be invoiced to the Internet User by the carrier.

What does it mean to take back my old electrical and electronic products?

In accordance with the decree of 8 October 2014 taken in application of the decree n° 2014-928 of 19 August 2014, ENERGY BIKE undertakes to take back your used electrical and electronic equipment within the limit of the quantity and type of equipment sold, as soon as you have made a request to our customer relations centre within 15 days of the order.

Article 4 – Reservation of ownership

energy-bike.fr retains full ownership of the items purchased by the Internet user until the Internet user has fulfilled all his obligations and in particular until full payment of the price, plus interest if applicable.

Article 5 – Withdrawal

5.1 Conditions of the right of withdrawal

In accordance with the legal provisions in force, the Internet user has a withdrawal period of 14 days from the date of receipt of the order. However, energy-bike.fr extends this period to 30 calendar days from the date of delivery.

In accordance with Article L.221-28 of the Consumer Code, this withdrawal period is not applicable in particular:

for the purchase of perishable goods, such as foodstuffs.
for the purchase of audio or video recordings, computer software, when they have been detected by the Internet user.
for the purchase of products made to the consumer’s specifications or clearly personalised. The right of withdrawal is at the expense of the Internet user in accordance with the procedures set out below. You may withdraw without giving any reason.

5.2 How to exercise the right of withdrawal

The Internet user can go to the “My account” section, “Track my orders” in order to obtain a return number enabling the reason for the return to be qualified.

The Internet user may also notify his decision to withdraw from this contract by means of a clear and unambiguous statement to the following address within 14 days of receiving his order:

If he/she so wishes, the Internet user may use the model withdrawal form available in the appendix to these general conditions of sale.
The user must return the goods to the following address, within 14 days after the withdrawal: Warehouse ENERGY BIKE (Centre des retours e-commerce) – 15 BOULEVARD GÉNÉRAL VAUTRIN RÉSIDENCE VICTOR HUGO06400 CANNESt. He can also return his product(s) in one of the ENERGY BIKE shops in France.
In the event of a return, the Internet user must pack the item concerned carefully and enclose his return number(s) in his shipment by printing them out from the site or by copying them onto a blank piece of paper (in the event that he wishes to follow the return procedure provided on the Site).
The Internet user is free to choose the method of shipment of his product and to take out insurance in case of loss, theft or destruction of his package. energy-bike.fr does not cover any of these costs nor the cost of transport and cannot be held responsible for the non-receipt of the Internet user’s package. The Site advises Internet users to opt for a tracked shipment of the package. In general, all costs and risks related to the return of the product are borne by the Internet user.
Only products returned complete, in perfect condition and in their original packaging will be accepted. Otherwise, the return will be considered as a non-compliant return and will not be reimbursed by energy-bike.fr.

5.3 Effects of withdrawal

In the event that the Internet user respects the return procedure described above, the refund will take place within 14 days following the date of receipt of the products by energy-bike.fr. This refund date may be deferred until the product has been recovered or until proof of shipment of the product has been sent to energy-bike.fr, the date retained being that of the first of these facts.
In the case of payment by credit card, the refund is made directly to the Internet user’s credit card.
In the event of a partial return of an order, energy-bike.co.uk will reimburse the customer for the amount of the shipping costs (one way) in proportion to the total amount of the order. In the event of a full return of an order, energy-bike.com will refund the customer the total amount of the shipping costs paid at the time of the order. energy-bike.com is not legally obliged to refund the additional shipping costs if you have chosen a more expensive shipping method than the standard one offered on the website.

5.4 Returns and exchanges policy

You have 365 days to exchange or get your money back in any ENERGY BIKE shop in France. See conditions.

Article 6 – warranties/service

6-1 General information

– Legal warranty: Independently of any commercial warranty that may be granted to the Internet user, energy-bike.fr remains liable for defects in conformity of the goods sold in accordance with Articles L217-3 to L217-4 of the French Consumer Code, partly reproduced below. energy-bike.fr also remains liable for the legal warranty of hidden defects under the conditions set out in Articles 1641 to 1648 of the French Civil Code, as well as in Article 2232 of the same code, partly reproduced below “Legal guarantee of conformity” (extract from the Consumer Code). “The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility”.Art. L 217-5. “The goods conform to the contract:
1° Whether it is fit for the use normally expected of similar goods and, if so :
- if it corresponds to the description given by the seller and has the qualities presented to the buyer in the form of a sample or model;
- it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

Art. L. 217-12. “The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.

“Guarantee of hidden defects (extract from the Civil Code)
– Art. 1641. “The seller is bound by the warranty for hidden defects in the thing sold which make it unfit for the purpose for which it was intended, or which so diminish that purpose that the buyer would not have acquired it, or would have given a lower price for it, if he had known of them.
– Art. 1648 – paragraph 1: “The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect. The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
– Art 2232 of the Civil Code “The postponement of the starting point, the suspension or interruption of prescription may not have the effect of extending the period of extinctive prescription beyond twenty years from the day on which the right arose. The first paragraph is not applicable in the cases mentioned in articles 2226, 2227, 2233 and 2236, the first paragraph of article 2241 and article 2244 [du même Code]. Nor does it apply to actions relating to the status of persons.

energy-bike.fr thus reminds the consumer that in the context of the legal guarantee of conformity :

– he has a period of two years from the delivery of the goods to act;
– he may choose between repairing or replacing the goods, subject to the cost conditions set out in Article L. 217-9 of the Consumer Code;
– he is exempted from proving the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from 18 March 2016, except for second-hand goods.

The consumer is also informed that the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted. Also, the consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and, in this case, he may choose between the resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

– Commercial guaranteeSome products sold on the Site may benefit from a commercial guarantee, the duration of which is mentioned on the product page of the items concerned.
In the event that the item ordered by the Internet user is covered by a commercial guarantee, the latter shall receive, at the latest at the time of delivery of his/her order, a document in which the content of the commercial guarantee, its implementation modalities, its possible price, its duration, its territorial scope, as well as the name and address of the guarantor shall be specified. However, this guarantee will not apply in the event of a problem caused by negligence, deterioration or inappropriate use of the product by the Internet user. Indeed, energy-bike.fr draws the attention of the Internet user to defects or malfunctions that may only be the consequence of poor installation or handling of the equipment. In this sense, energy-bike.fr invites the Internet user to follow the instructions in the troubleshooting guides available on the site and to perform several tests on the equipment received.
6-2 Methods of exercising guaranteesIf the Internet user’s product proves to be defective during the legal or commercial guarantee period or does not comply with the order, he/she shall make a request for after-sales service to energy-bike.fr. aTo make a return to energy-bike.fr, the Internet user must go to the “My account” section, “Track my orders” and specify the difficulties or malfunctions encountered on the product(s) concerned. This step will enable him/her to obtain a return number.
As part of the warranty, energy-bike.fr offers the Internet user either to bring the product to an ENERGY BIKE shop located in Metropolitan France or Corsica, or to send the product back to energy-bike.fr. The shipping costs will be paid in accordance with the law, regardless of the solution chosen. It is hereby specified that all shipping costs related to a return under a commercial warranty will be borne exclusively by the Internet user.
After processing the product by energy-bike.fr, which will check in particular whether the product is covered by the legal or commercial guarantee, the product will be repaired or exchanged. If the cause of the breakdown falls within the scope of the legal or commercial guarantee, and the product cannot be repaired and cannot be exchanged for an identical or equivalent product, it will be reimbursed in the form of a credit note or refund. In all cases, energy-bike.fr will propose the most appropriate solution (replacement of the defective part, replacement of the article or refund).
In the event of abnormal or abusive returns or if the Internet user has not read and applied the instructions in the troubleshooting guides provided on the site, the return will be considered as a non-compliant return and treated as such. Similarly, all products returned without a return number will systematically be treated as non-compliant returns. It is reminded that the Internet user is free to choose the method of shipment of his product and whether or not to take out insurance in the event of loss, theft or destruction of his package. energy-bike.fr does not bear any of these costs and cannot be held responsible for the non-receipt of the package by the Internet user. Finally, the Internet User is responsible for the packaging of his product, which must be done in such a way that the product can travel without risk of breakage or damage.

7.2 Mediation of consumer disputes

In accordance with Article L 612-2 of the Consumer Code, one of the prerequisites for the examination of the dispute by MEDICYS is the following: the consumer must prove that he/she has previously tried to resolve his/her dispute directly with ENERGY BIKE’s Customer Service, by means of a complaint sent by mail or e-mail as defined in 7.1

7.3 Online dispute resolution

The European Commission provides an online platform for dispute resolution.

Article 8 – Completeness

The present General Terms and Conditions of Sale are made up of all the clauses that make them up. The fact of not availing oneself at a given moment of any of the clauses of the present General Terms and Conditions of Sale shall not constitute a waiver of the right to avail oneself of these same clauses at a later date. In case of invalidity of one of them, the other clauses remain valid.

Article 9 – Applicable law / disputes

9.1 These General Terms and Conditions of Sale are subject to French law. The competent court in the event of a dispute shall be that of the defendant’s place of residence or, at the choice of the plaintiff, the place of actual delivery of the product.

The consumer is informed of the possibility of having recourse, in the event of a dispute, to a conventional mediation procedure or to any other alternative dispute resolution method.

9.2 In the context of a sales contract between professionals, the Parties expressly agree to submit this contract to French law.
The Parties expressly agree that the Vienna Convention on the International Sale of Goods cannot be applied to their relationship. To this end, any dispute that has not been resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Versailles, notwithstanding multiple defendants and/or third party claims, even for emergency proceedings or protective proceedings in summary proceedings or by petition.

1 – Preamble

These terms of use are concluded between any Internet user of the website (hereinafter referred to as “the User”) and the website “ENERGY BIKE.fr”, operated by the company ENERGY BIKE France, SAS with variable capital, registered in the RCS of Cannes under the number 845 175 595 00022 and whose registered office is located at 15 BOULEVARD GÉNÉRAL VAUTRIN RÉSIDENCE VICTOR HUGO06400 CANNES; hereinafter referred to as “the Site” or “ENERGY BIKE.fr”.
ENERGY BIKE France belongs to the “ENERGY BIKE NETWORK”. This refers to ENERGY BIKE SA and all the companies it owns, directly or indirectly, at least 10% of the capital or voting rights (hereinafter referred to as “ENERGY BIKE Subsidiaries” or “ENERGY BIKE NETWORK Companies”).
The website “ENERGY BIKE.fr” means the website accessible mainly from the URL https://www.ENERGY BIKE.fr and allowing Users to benefit from the features described in Article 2. ENERGY BIKE.fr restricts the use of its Site to Users who are private individuals and who use it on a normal basis. The use of or access to the Site is strictly forbidden to any individual or legal entity using the Site for professional purposes or as part of an accessory professional activity.

3 – Conditions of use of the site

3.1 The Site is reserved for adults who are private individuals and for minors who have parental consent. In any case, ENERGY BIKE.fr encourages any person responsible for a minor to control the use of the Site by the latter.

3.2 Access to certain services offered by the Site may be subject to the creation of an Account requiring the communication, by the User, of information allowing his identification. For the purposes of these Terms of Use, “Content” is defined as any element posted by the User on the Site, such as text, comments, images, photos, videos, or any type of file, regardless of its content or form.

4.2 The User is responsible for anything that may occur in his name and from his computer terminal. The User undertakes to inform the Site immediately, in the event that he has reason to believe that his pseudo or email address is, or may be, known by a person not authorised to use it. The Site declines all responsibility in the event of use of a User’s personal data by an unauthorised third party.

4.3 The Site may only be used for personal and non-commercial purposes. Under no circumstances may the User communicate commercial information or engage in any trade on the Site, in any form whatsoever and for any purpose whatsoever.

5 – Behaviour on the site

The User shall in particular refrain from :

– Committing any illegal act ;
– To extract or collect personal data from users of the Site by any means;
– To extract, record or exploit, for purposes other than the sole display during navigation of this Site, the contents of third parties subject to intellectual property rights, relating to privacy, personal data or image rights;
– Store, disseminate or publish any content that is illegal, harmful, abusive, racist, inciting to hatred, revisionist, contrary to good morals, infringing on privacy or infringing on the private rights of third parties, in particular the right to the image of persons and goods, intellectual property rights or the right to privacy.

In general, the User agrees to refrain from any behaviour that is contrary to sporting ethics or the values and interests of the ENERGY BIKE Network.

6 – Intellectual property

6.1 Content published by the Site

The Content on the Site is subject to proprietary rights and protected under intellectual property laws, including copyrights, designs, trademarks, domain names, patents, know-how, software or databases. The ENERGY BIKE NETWORK and its partners remain the owners of all these Contents and associated rights.
ENERGY BIKE NETWORK grants Users a limited, non-exclusive, revocable, non-sublicensable license to access, browse and use the Content on the Site. This license does not grant Users any other right, in particular no right of commercial exploitation of this Content.

6.2 Content published by Users

All Content (including text, comments, files, images, photos, videos, works, etc.), which may be subject to property rights, intellectual property rights, image rights or other private rights, remain the property of the User, subject to the limited rights granted by the license defined below to the ENERGY BIKE NETWORK or the application, on a case-by-case basis, of other specific conditions previously accepted for specific services potentially available on the ENERGY BIKE NETWORK sites. Users are free to publish or not such Content on the Site via the “Photo Sharing” service and accept that this Content becomes public and freely accessible on the Internet. They acknowledge, undertake and guarantee that they have all the rights and authorisations necessary for such publication on the Site, in particular with regard to the legislation in force and the rights to privacy, property, intellectual property, image, contracts or of any other nature. By publishing the Content on the Site, Users acknowledge that they are responsible as the publisher of the Content within the meaning of the law, and grant ENERGY BIKE a non-exclusive, royalty-free, worldwide license to use the Content, including the right to reproduce, display, perform, transmit, and store the Content, and to sublicense the Content to its affiliates, technical partners, and other Users of the Site, for the duration of the publication.
Users also authorize that their name may be associated with the Content and accept that this association is not always made. By their publication, Users authorise that Content may become automatically accessible on the Internet, in particular on other sites and/or blogs and/or web pages of the ENERGY BIKE Network including in particular the pages of the ENERGY BIKE social networks or Users of the ENERGY BIKE sites who may share certain content. Users may ask ENERGY BIKE to stop their publication in accordance with the terms and conditions set forth in Article 8 of these Terms of Use.
By posting a review or comment on the “ENERGY BIKE Review Service”, the User acknowledges that this review becomes public and grants ENERGY BIKE Group companies and their duly authorized partners the right to use, store, publish, translate, create derivative works from, exploit, distribute, and display the content, in whole or in part, of the review and/or comment, within the framework of any protection under intellectual property rights from which they may benefit, and to use the name and/or first name supplied with the notice or comment for all purposes, in particular commercial and advertising purposes, on all media, in particular the internet, emailing (paper and/or online), posters, signage, point-of-sale advertising, leaflets, advertisements, magazines, television and radio media and similar media, throughout the world and for a period of 10 years.

7 – Liability

7.1 Responsibility of ENERGY BIKE.fr

7.1.1 Consultation and use of the Site is under the responsibility of the User. The Site may contain links to third-party sites. By clicking on these links, the User acknowledges that ENERGY BIKE.fr cannot guarantee the content of these sites, and therefore accepts to access them at his own risk. Consequently, ENERGY BIKE.fr cannot be held responsible for any damage resulting from the access and/or use of the Site and the information it contains. 7.2 Responsibility of the User

7.2.1 By using the Site, the User agrees to hold ENERGY BIKE NETWORK harmless and indemnify ENERGY BIKE NETWORK from any and all damages, costs and expenses, direct and indirect, resulting from:

– Any claim by a third party concerning any content submitted on its behalf, in particular for infringement of rights to content published by the User on the Site or press offences in connection with material sent or published on the Site;
– Any activity relating to participation on the Site contrary to these terms and conditions, including for fraudulent purposes;
– Violation of these Terms of Use of the Site.

7.2.2 Decatlhlon.fr wishes to make its Users aware of the publication of Content, such as shots or other photos of Users.
ENERGY BIKE.fr draws the attention of its Users to the need to publish or share photographs, images or videos that are respectful and consistent with the ethics of sport and the values of the ENERGY BIKE NETWORK. Any non-conforming Content will be systematically removed from the Site.

8 – Deletion of content submitted by users

8.1 ENERGY BIKE.fr may terminate any registration and/or delete any profile and/or any content and/or any information published on the Site and/or prohibit the use of and/or access to the Site, as soon as it becomes aware of the User’s non-compliance with these general terms of use or for technical reasons. This modification or deletion may be made without prior notice or warning, at any time and at the sole discretion of ENERGY BIKE.fr.
Via the “Report abuse” procedure, each User may inform the Site, by enclosing all the details necessary to process his or her request, that Content is presumed to have been published in violation of these conditions of use.

8.2 The User also has the possibility of deleting Content posted on the Site. To do so, he/she must formulate a request to remove the Content via the contact form.
This request must imperatively be accompanied by information allowing the identification of the said content. For content uploaded via the “Photo Sharing” service, the information required for deletion is as follows: surname, first name, email address used when uploading the content, year of upload, title of the content.
Any legitimate request will be processed as soon as possible by ENERGY BIKE.fr without the latter being able to guarantee an immediate removal of access to the content, the User acknowledges that ENERGY BIKE.fr can not incur any liability in this regard, particularly because of the time required to process the request, technical constraints or physical impossibility to respond, particularly in the case where the Content has been taken over by third parties.

9 – Completeness

If one or more stipulations of the general conditions of use are declared null and void by application of a law, a regulation or following a final judicial or administrative decision, the other stipulations will retain their force and scope. ENERGY BIKE.fr will make its best efforts to replace it as soon as possible with a valid provision that is as close as possible to the spirit of this Agreement. The fact that one of the parties has not required the application of any clause of these conditions, permanently or temporarily, can in no way be considered as a waiver of that clause.

10 – Applicable law / disputes

These general conditions of use are governed by French law.

LEASE CONTRACT

The term Renter defines the Company that owns the vehicle. The term cycle defines any model of bicycle. The renter rents to the tenant, whose signature is affixed on the contract, the bicycle described in the clauses and conditions stated in the contract, which he accepts and commits himself to observe. The tenant can neither sublet nor lend the bicycle which remains the exclusive property of SARL ENERY BIKE.

Article 1 – USE OF THE VEHICLE :

The hirer undertakes that the cycle will not be used:

a) In the context of competitions, except with the prior written consent of the Hirer.

(b) By a person under the influence of alcohol or narcotics, or any substance likely to affect his conduct.

d) When overloaded, for example when the rented cycle carries more than 1 passenger (except for children whose weight remains below the load tolerated by the manufacturer).e) The hirer also undertakes :

• to keep the said cycle protected by an anti-theft device and/or any other means at his disposal to prevent theft of the said cycle, outside periods of use, by keeping the keys in his possession. The hirer also undertakes to use the anti-theft device at each stop.

• to return the keys imperatively to the counter and in the hands of the hirerFailing this, the hirer will be held responsible if the cycle is stolen. Except in the case of theft, the hirer will be responsible for all the costs that the Hirer will have had to incur to remake the keys and regain possession of the cycle and for all the contraventions occurring in the 72 hours following the rental, if applicable.never to transfer the present contract, nor to sell, mortgage or pledge the cycle, its equipment, or its tools, nor to treat them in such a way as to be detrimental to the Hirer. Any breach of any of these commitments entitles the Hirer to demand the return of the cycle without delay by any legal means at his convenience.

Article 2 – CONDITION OF THE VEHICLE

The hirer acknowledges that he/she has received the said cycle in perfect working order and cleanliness. All equipment (tyres, engines, etc.) is in good condition. In case of deterioration of any of the equipment of the object of the rental for a cause other than normal wear and tear, the hirer undertakes to replace the damaged equipment immediately at his own expense.The hirer is responsible for damage other than normal wear and tear, suffered by the cycle as a result of the use of routes unsuitable for traffic, or, when the Law allows it, for all other causes outside the control of the Renter.

Article 3 – RENTAL – PAYMENT – EXTENSION

The rates applicable to the rental are those in force at the time of signing the contract. The rental price is payable in advance, accompanied by a deposit of 100 to 3000 euros depending on the type of bike, and the amount of advance payment is determined according to the duration agreed in the contract and the rates in force.In order to avoid any dispute, the hirer who would like to keep the bike for a longer time than that agreed at the start, must obtain the prior agreement of the Hirer and immediately send the balance of the rental, if any, and the advance payment corresponding to the new agreed duration. Any rental period exceeded without having obtained the prior agreement of the Hirer will be invoiced at the price of one day’s rental. In no case may the advance payment be used to extend the rental period. The hirer undertakes to return the cycle to the Hirer on the date stipulated in the rental contract, failing which, except in cases of force majeure, he will be liable to civil or criminal legal proceedings. The hirer undertakes to give the exact and complete address of his residence at the start of the rental.

Article 4 – PAYMENTS

The persons whose references appear on the contract are obliged to pay in accordance with Articles 1200 and following of the Civil Code: In the event of theft or damage to the vehicle, the hirer will be liable for a lump sum of €2,000. (If the cost of the damage, after compensation of a responsible third party, if any, is less than the amount of the prepaid deposit, the hirer will only be liable for the remaining cost to the lessor. In the event of theft: In the event of theft, the hirer will be liable for the full amount of the deposit. In the absence of damage or theft, the prepaid deposit will be reimbursed after the final receipt of the payment title presented.If the hirer does not comply with the stipulations of these general rental conditions, he will also be liable for any damage to the cycle or its market value. All fines, costs, expenses and taxes on all traffic, parking or other violations of the law are to be paid by the hirer during the term of this contract. Any complaints regarding the vehicles or invoicing must be made within 30 days of the date of the invoice.

Article 5 – INSURANCE (SCOPE – EXCLUSIONS) :

The hirer undertakes, on pain of losing the benefit of the insurance, to declare any accident to the lessor, as well as to the police authorities before the end of the rental period and in any case within a maximum period of 24 hours.The hirer declares that he/she benefits personally from an insurance against physical accidents which covers him/her in particular in the event of using cycles. The hirer who accedes to a cycle undertakes to submit a duly completed declaration on his return or later in the event of force majeure. Failure to comply with any of the above obligations will result in the forfeiture of the insurance cover for damage to the cycle.d) The Hirer declines all responsibility for accidents to third parties or damage to the cycle that the Hirer may cause during the rental period if he/she has deliberately provided false information concerning his/her identity and/or address.

Article 6 – MAINTENANCE AND REPAIR :

Normal mechanical wear and tear is the responsibility of the Hirer. In the event that the cycle is immobilised, repairs can only be carried out after written agreement and according to the Hirer’s instructions, they must be the subject of a paid and detailed invoice, the defective parts replaced must be presented with the paid invoice.

Article 7 – LIABILITY:

The Hirer is responsible for any traffic offences committed by him/her while driving the vehicle and expressly authorises the Hirer to communicate his/her civil status and address to the Police or Gendarmerie on request.

Article 8 – VALIDITY OF THE CONTRACT:

Any changes to the terms and conditions of this contract, if not made in writing, shall be null and void.

Article 9 – SETTLEMENT OF DISPUTES:

In case of any dispute relating to the present contract and insofar as the Law allows it, the territorially competent Court on which depends the Head Office of SARL ENERY BIKE will be the only one competent.

Pourquoi transférons-nous vos données ?
Le transfert de vos données en dehors de l’Union Européenne s’explique principalement par la localisation de nos sous-traitants.
En effet, afin de vous proposer un service de qualité, nous avons décidé d’externaliser certaines opérations auprès de prestataires spécialisés qui disposent d’une réelle expertise dans leurs domaines (Un exemple ? L’hébergement). Et certains de ces prestataires sont établis en dehors de l’Union Européenne.
Comment sont encadrés ces transferts de données ?
Quels que soient les pays où sont établis nos sous-traitants, nous les sélectionnons toujours avec la plus grande vigilance. C’est tout particulièrement le cas en ce qui concerne la manière dont sont sécurisées vos données. Ces sous-traitants n’agissent que sur instruction de ENERGY BIKE et n’utilisent à aucun moment vos données pour autre chose que l’exécution des prestations que nous leur confions. Un contrat est systématiquement conclu entre ENERGY BIKE et les sous-traitants sélectionnés.
Lorsque que nos prestataires sont établis en dehors de l’Union Européenne, nous avons à coeur de les sélectionner en priorité dans des pays dont le cadre légal apporte un niveau de sécurité satisfaisant.

Lorsque cela n’est pas possible, nous encadrons ces transferts par des mécanismes juridiques appropriés, notamment la signature de clauses contractuelles supplémentaires spécialement prévues pour ce type de transfert ou encore l’auto-certification au Privacy Shield (ce dernier mécanisme n’étant valable que pour les prestataires basés aux Etats-Unis). https://www.cnil.fr/fr/le-privacy-shield

Le fait de nous confier vos données ne signifie pas que vous perdez la maîtrise de celles-ci, bien au contraire ! Un peu d’explication…

Le droit d’accès :

Il vous permet également de nous demander une copie de l’ensemble des informations vous concernant. Ce droit s’applique quel que soit le fondement juridique du traitement vous concernant.
Le droit de rectification :
Déménagement, mariage, nouveau sport, … nombreuses sont les situations pouvant vous conduire à mettre à jour vos données. Le droit de rectification sert précisément à ça. Ce droit s’applique quel que soit le fondement juridique du traitement vous concernant.
Le droit d’opposition :
C’est le droit de dire «non !» , le droit de ne pas figurer dans un traitement de données ou de de ne plus y figurer. Ce droit s’applique lorsque le traitement repose sur « l’intérêt légitime » de ENERGY BIKE, pourvu que cet intérêt ne soit pas «impérieux ».
Droit à l’effacement :
C’est le droit d’être oublié… et c’est bien normal. ENERGY BIKE n’a aucune raison de conserver vos données au delà de ce qui est nécessaire. Toutes les données vous concernant sont donc automatiquement supprimées à l’expiration du délai de conservation annoncé lors de la collecte de vos données.
